ElectricFish Turbo Charge Program — SMS Privacy Policy

This SMS Privacy Policy (“SMS Policy”) describes how ElectricFish Energy, Inc. (“ElectricFish,” “we,” “our,” or “us”) collects, uses, and protects information in connection with our SMS/text messaging communications for the Turbo Charge program. This SMS Policy supplements our general Privacy Policy.

1. Information We Collect Through SMS

When you opt in to receive text messages from ElectricFish, we collect:

• Your mobile phone number
• Your consent to receive SMS (whether provided verbally during a call or through our website sign-up form)
• Records of text messages sent to and received from your number
• Your opt-in and opt-out status

2. How We Use This Information

We use your mobile phone number and SMS opt-in data solely to:

• Send text messages related to the Turbo Charge program, including program information, registration links, site qualification updates, and installation scheduling
• Process opt-out requests when you text STOP
• Respond to HELP requests
• Maintain records of consent for compliance purposes

3. How We Protect This Information

We will not share, sell, or disclose your mobile phone number, SMS opt-in data, or text message consent with third parties or affiliates for marketing or promotional purposes.

This excludes service providers and infrastructure partners required to deliver SMS communications.

4. Data Retention

We retain your mobile phone number and opt-in/opt-out records for as long as you are subscribed to receive messages, and for a reasonable period afterward to comply with legal and regulatory requirements. If you opt out by texting STOP, we will retain a record of your opt-out to ensure we do not send future messages.

• Request deletion of your mobile information, subject to legal obligations to retain opt-out records

6. Children’s Privacy

Our SMS program is directed at business owners and operators. We do not knowingly send text messages to or collect mobile information from anyone under the age of 18.

7. Changes to This Policy

We may update this SMS Policy from time to time. When we do, we will revise the “Last Updated” date above. Continued participation in our SMS program after material changes constitutes acceptance of the updated policy.
